1. Reporting infringement
If you believe content on Clear Air Stays infringes your copyright, send our designated agent a written notice that includes:
- your physical or electronic signature;
- identification of the copyrighted work you claim is infringed;
- identification of the material you claim is infringing and where it is on the site (a link is best);
- your name, postal address, telephone number and email address;
- a statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent or the law;
- a statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act for the owner.
A notice that does not substantially include these elements may not be acted on. Under 17 U.S.C. §512(f), anyone who knowingly materially misrepresents that material is infringing, or that it was removed by mistake, may be liable for damages, including costs and attorneys’ fees. Before sending a notice, consider whether the use could be fair use or licensed.
2. Designated agent
Our designated agent, registered with the U.S. Copyright Office (registration DMCA-1084256), is: Copyright Agent, Clear Air Stays LLC, 7901 4th St N, Ste 300, St. Petersburg, FL 33702; telephone (954) 930-5959; email support@clearairstays.com (subject: “Copyright notice”). Notices sent elsewhere may not reach the agent.
3. Counter-notice
If your content was removed and you believe it was a mistake or misidentification, you may send the agent a counter-notice with your signature; identification of the removed material and where it appeared; a statement under penalty of perjury that you have a good-faith belief it was removed by mistake or misidentification; your name, address and telephone number; and your consent to the jurisdiction of the federal court for your district (or, if you are outside the United States, any district where we may be found) and to accept service from the person who sent the original notice. We will send a copy of your counter-notice to the person who sent the original notice. We may restore the material 10 to 14 business days after receiving a valid counter-notice unless the complaining party tells us it has filed a court action. Your counter-notice, including your name, address and telephone number, will be sent to the person who sent the original notice. We forward copyright notices, with the sender’s contact details, to the person whose content was removed.
4. Repeat infringers
We close, in appropriate circumstances, the accounts of users who repeatedly infringe copyright. See also the Terms of use.
