1. This agreement
These terms are an agreement between you and Clear Air Stays LLC, a Florida limited liability company (“Clear Air Stays”, “we”, “us”). They apply to clearairstays.com and everything on it (the “service”). You accept them by ticking the box that links them when you create an account, when you request a stay, and when we ask you to accept a new version (section 18). We record the version you accepted (this version is 2026-10-30.1) with your account and with each booking request.
You agree to receive these terms, notices, receipts and other records electronically, and that ticking the box is your electronic signature. You can download or print any page of this site, and you can ask us for a paper copy of a record at the contact address above; a paper copy is free. To read these records you need a current web browser and an email account. You may withdraw consent to electronic records by closing your account.
Section 16 requires most disputes to be resolved by individual arbitration and waives class actions. Section 15 limits our liability. Section 5 explains that we cannot predict how any person will respond to a home. Please read them.
2. Eligibility and your account
- You must be at least 18 years old and able to enter a binding contract.
- One account per person. The information you give us must be accurate and current.
- You are responsible for activity under your account. Keep your password private. If you think someone else has it, reset it; a reset signs out every other device.
- Before your first booking request you must confirm a mobile number and verify a government ID through our identity provider, as the Privacy notice describes.
3. What Clear Air Stays is
Clear Air Stays is a directory of short-term rental homes whose hosts have confirmed a fragrance-free standard. We are not a host, we do not own, manage, inspect or control any property, and we are not a party to the rental agreement between a guest and a host. We operate the website, the standard a home must meet to be listed, the review of what the host supplied, and the booking request, which we pass to the host.
4. What being listed means
A home is listed because its host confirmed every requirement in the published standard (version 2026.3) and supplied photographs of the cleaning and laundry products in use, and because we read those photographs against the host’s answers before the listing was published.
That review is a reading of what the host supplied. We do not visit, inspect or test homes. We rely on the host’s answers and photographs being true. Every other feature a listing states, such as an air purifier, no carpet or windows that open, is an amenity the host has declared and we have not inspected. A home can change between our review and your arrival.
5. Homes are described by their hosts; individual response varies
Homes are described by their hosts. We cannot predict how any person will respond to a home, and we do not promise that a stay will suit you. Being listed is a statement about a property, not about you. You decide whether a home meets your needs, and you choose to stay there at your own risk, to the extent the law allows. Nothing on the service is medical advice. Section 15 applies.
6. Booking, payment and cancellation
Prices are in US dollars. Before you commit, the full amount is shown with every line itemised: the nightly rate after any discount, and the cleaning, extra-guest and pet fees the host charges. Clear Air Stays charges guests no fee. Clear Air Stays does not collect or remit lodging, occupancy or sales tax; where a tax applies it is the host’s responsibility.
The host is the merchant of record for the booking. When you request a stay, your card is authorized on the host’s payment account for the full amount. On a request-to-book listing nothing is captured until the host accepts; if the host declines or the request expires, the authorization is released. On an Instant Book listing the host has accepted in advance, and the payment is captured when you book. Clear Air Stays’s fee is paid by the host out of the booking.
Each host chooses a cancellation policy. The policy that applies is shown on the listing before you book and on your trip page afterwards, with the exact amount a cancellation would return that day. Refunds of the booking payment are made by the host under that policy. A refund never exceeds the amount captured from you. Clear Air Stays does not refund or compensate a stay. The policies a host can choose are:
- Flexible. Full refund up to 24 hours before check-in.
- Moderate. Full refund up to 5 days before check-in.
- Firm. Full refund up to 30 days before check-in.
- Strict. Full refund if cancelled at least 60 days before check-in.
- Custom. A host may set their own refund terms, which are shown on the listing before you book.
Section 5 and section 15 apply to every booking.
7. Report a problem
If a home you booked is not fragrance-free as its listing states, you can report it within 12 hours of your check-in time. Tell the host first; then report it to us. We tell the host and look at the report; the listing stays up while we do. A report does not cancel or refund the booking. Any refund is between you and the host under the host’s cancellation policy (section 6).
A report concerns the home against what its listing states: the fragrance-free requirements and the amenities the host declared. Include a description and, if you can, photographs.
8. Payments outside Clear Air Stays
Do not ask for, offer or make payment for a stay found on Clear Air Stays outside the service. We may remove a listing or close an account that does. A payment made outside the service is not processed, recorded or covered by these terms’ booking and cancellation provisions, and we cannot help you recover it.
9. Acceptable use
You agree not to:
- scrape, crawl or copy the service or its listings by automated means without our written permission;
- commit fraud, misrepresent yourself or a property, or use someone else’s account or payment method;
- harass, threaten or discriminate against anyone, including on the basis of race, colour, religion, national origin, sex, disability, familial status or any other characteristic protected by law;
- post fake, paid or conflicted reviews, or reviews of a stay you did not take;
- interfere with the security or operation of the service;
- use the service for anything unlawful.
10. Your content, reviews and reports
You keep ownership of the photographs, listing text, reviews and messages you post. You give Clear Air Stays a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, display and adapt that content (for example, resizing a photograph) for the purpose of operating and showing the service, for as long as it is on the service and for a reasonable period after for backups and records. You confirm you have the rights to what you post.
Reviews may be written only by a guest who completed the stay. We do not edit reviews for tone. We may remove content that identifies a person, is not about the stay, is abusive, discriminatory, fake or clearly false, or that the law requires us to remove. We apply these rules to every review whatever its rating, and we never remove a review because it is negative. Anyone can report a listing; a listing report is reviewed by a person before we act on it. A problem report under section 7 requires a confirmed booking.
11. Copyright
We respond to notices of claimed copyright infringement under the Digital Millennium Copyright Act and close the accounts of repeat infringers in appropriate circumstances. How to send a notice or counter-notice is set out in our copyright policy.
12. Email and text messages
We send email about your account and your stays (confirmations, cancellations, password resets). These are transactional and are sent while you have an account or an active stay. Any other email is a preference you control on your account page, and every such email carries an unsubscribe link that we honour within 10 business days.
We text a verification code to the mobile number you confirm. We send other texts about your stays only if you turn them on. Message and data rates may apply. Reply STOP to any text to stop texts, or turn them off on your account page. Consent to texts is not a condition of booking.
13. Third-party services
Payments are processed by Stripe under Stripe’s own terms. Maps are drawn from third-party map data and tiles under their providers’ terms. We are not responsible for those services, and your use of them is governed by their terms.
14. Hosts
If you list a property, the Host terms also apply to you and form part of this agreement. Where they conflict with these terms on a matter between a host and Clear Air Stays, the Host terms control.
15. Disclaimers and limits of liability
Except for what these terms expressly say we do, the service is provided “as is” and “as available”, without warranties of any kind, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not warrant the condition, safety or suitability of any home, or the accuracy of what a host states.
To the extent the law allows, Clear Air Stays is not liable for indirect, incidental, special, consequential or punitive damages, or for the acts or omissions of any host or guest, and our total liability to you for all claims is limited to the greater of the amount you paid to Clear Air Stays itself (not to a host) in the 12 months before the claim, or US$100. These limits do not apply to liability for death or personal injury caused by our negligence, for fraud, or to anything else the law does not allow us to limit. Where your state does not allow a limit, it applies as far as that law permits.
16. Disputes and arbitration
Please write to us first at support@clearairstays.com; most problems are settled that way. If a dispute between you and Clear Air Stays is not resolved within 60 days, it will be resolved as follows.
- Arbitration. The dispute will be decided by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules, including its procedures for mass or multiple filings, not in court. The Federal Arbitration Act governs this section. Fees are paid as those rules provide.
- Who decides. The arbitrator decides any question about whether a dispute must be arbitrated, including the scope, validity and enforceability of this section, except that a court decides the class-action waiver below.
- Small claims. Either of us may instead bring an individual claim in a small-claims court that has jurisdiction.
- No class actions. Claims may be brought only individually, not as a plaintiff or class member in any class, collective or representative proceeding.
- Public injunctive relief. A claim for public injunctive relief that the law of your state does not allow to be waived may be brought in court, and is paused until the individual claims are arbitrated.
- Opting out. You may opt out of this section by emailing support@clearairstays.com within 30 days of first accepting these terms, with your name and the email address on your account. Opting out does not affect the rest of these terms.
- Changes to this section. We will give you at least 30 days’ notice before a change to this section takes effect. A change does not apply to a dispute of which we had notice before the change.
- Law and courts. These terms are governed by the laws of the State of Florida, without regard to its conflict-of-law rules, and by the Federal Arbitration Act. Any claim not subject to arbitration will be brought only in the state or federal courts located in Duval County, Florida, and you and we consent to their jurisdiction.
Disputes between a host and Clear Air Stays are governed by the Host terms.
17. Suspension and termination
You can close your account at any time through help and support. We may suspend or close an account, or remove a listing or content, if we reasonably believe it breaks these terms or the law, or puts another person at risk. Sections 5, 10 (licence for content already shared), 11, 14 (including Host terms section 8 (indemnity) and section 9 (arbitration)), 15, 16, 19 and any payment obligation survive the end of this agreement.
18. Changes to these terms
We will tell you about a material change by email or on the site before it takes effect, and ask you to accept the new version before you next request a stay, send a message, write a review, accept a stay, set up payouts, list a home or edit a listing. A change does not affect a booking already requested. When the standard changes, existing listings keep the version they were reviewed under until they are reviewed again.
19. General
- Entire agreement. These terms, the Host terms (for hosts) and the policies they link are the whole agreement between you and us about the service.
- Severability. If a provision is found unenforceable, the rest remains in effect, and the provision is enforced as far as the law permits.
- No waiver. Not enforcing a provision is not a waiver of it.
- Assignment. You may not transfer this agreement. We may transfer it to a successor to our business.
- Notices. We send notices to the email address on your account. You send notices to support@clearairstays.com or the postal address above.
- Events beyond control. Neither of us is liable for a delay or failure caused by events beyond reasonable control.
