These terms apply in addition to the Terms of use to anyone who lists a property on Clear Air Stays (“you”, the host). By listing a property you accept both.
1. Identity and eligibility
You must verify your identity with a government document, through our identity provider, before a listing can go to review. You must have the legal right to rent the property and must act as an independent business, not as an employee or agent of Clear Air Stays.
2. Your answers and your listing
Your answers to the standard and everything your listing states must be true on the day of every arrival, not only on the day of review. If something material changes, such as a new cleaning product, a cleaner who brings their own supplies, or a pet, update the listing before the next guest arrives.
Listing content is yours. You supply it and you are responsible for it. Clear Air Stays displays it as provided and is not its author; we review what you supply against the standard, but that review does not make us the speaker of your listing.
3. Your property and the law
You are responsible for:
- the property, its condition and its safety, and your conduct and your guests’ safety there;
- the licences, permits, registrations and HOA or lease permissions that renting it requires;
- collecting and remitting any lodging, occupancy, tourist development or sales tax. Clear Air Stays does not collect or remit these taxes for you;
- complying with fair housing and anti-discrimination law. You may not refuse, or set different terms for, a guest on the basis of a characteristic protected by law;
- maintaining liability insurance appropriate to short-term rental of the property. Clear Air Stays does not provide insurance to hosts or guests.
4. Payments, fees and refunds
You are the merchant of record for each booking. The guest’s card is charged on your Stripe account: the charge, its refunds, and any dispute or chargeback on it are yours.
Clear Air Stays’s fee is 8% of the booking subtotal, including payment processing, collected as an application fee on your charge. You pay Stripe nothing for processing the charge; we pay Stripe’s processing and dispute fees. The booking subtotal is what the guest is shown as the full amount: the nightly rate after any length-of-stay or new-listing discount, plus the cleaning, extra-guest and pet fees you charge. Guests pay Clear Air Stays nothing.
- Apart from host referral credit (below), our fee is reduced only when a guest cancels through Clear Air Stays and is refunded under your cancellation policy, in the same proportion as that refund. A full refund returns the whole fee. A charge returned because the booking was never confirmed returns the whole fee with it.
- If you cancel a confirmed stay, the guest is refunded in full and our fee is not returned.
- Apart from host referral credit, Clear Air Stays makes no other refund and returns no fee for any other reason.
- A refund you make outside Clear Air Stays does not change our fee.
- If a guest disputes a charge, you respond to the dispute through Stripe and bear its outcome, as merchant of record. A dispute or chargeback does not change our fee.
You choose a cancellation policy for each listing. The policy shown to the guest when they book is binding on you for that booking, and you must make the refunds it provides.
Host referral credit
You may share your referral link with another person who wants to host. If they create an account or start hosting through it and then complete 5 stays, each of you receives $100 of fee credit.
- Fee credit is not cash. It cannot be paid out, transferred or exchanged. When a stay completes after the credit is added, we return our fee on that stay to your Stripe account, up to the credit left, until it is used up. It never returns more than our fee on that stay and does not change what the guest pays.
- You cannot refer yourself, including through a second account, another email address or a shared payout account. A host can be referred once, by one host. We may refuse or withdraw a referral that breaks these rules.
- We may change or end the referral program at any time, with notice on this page.
5. Stripe
Payment processing services for hosts on Clear Air Stays are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the “Stripe Services Agreement”). You accept the Stripe Services Agreement, with these terms, by ticking the box that links both when you submit a listing and when you set up payouts, and we record that acceptance. By agreeing to these terms or continuing to operate as a host on Clear Air Stays, you agree to be bound by the Stripe Services Agreement, as the same may be modified by Stripe from time to time. As a condition of Clear Air Stays enabling payment processing services through Stripe, you agree to provide Clear Air Stays accurate and complete information about you and your business, and you authorize Clear Air Stays to share it and transaction information related to your use of the payment processing services provided by Stripe. Stripe processes your data as described in the Stripe Privacy Policy. We will pass on notices we receive from Stripe about changes to its agreement.
6. Review, unpublishing and removal
We review what you supply before a listing is published. We may unpublish a listing at any time where the evidence no longer supports what it states. A guest’s problem report made within 12 hours of check-in does not unpublish a listing by itself: the listing stays up while we look at the report. We may remove a listing or close an account for a breach of these terms or the Terms of use, including off-platform payment requests and repeated copyright infringement.
Until you have completed one stay that no guest reported as an access failure, your listings take requests only (no Instant Book) and a single booking’s subtotal is limited to $1,500. A stay that a guest reports as an access failure (they could not get in, the place was not there, or you could not be reached) does not count as that completed stay. Such a report does not pause your listings.
7. Guest information
A guest may choose, for one booking, to share their stay preferences with you: the home features they picked, and nothing else. If they chose to share when requesting that booking, you see on that booking the features they had saved at the moment of the request, not any later changes; if they chose not to, you see none. Use what a guest shares, and their contact details, only to host that stay. Do not copy it, disclose it, or use it for marketing. Once a stay is confirmed, your guest sees the phone number on your account and the listing’s street address, arrival instructions and directions. Until then, the listing’s map shows an approximate area, not its exact location.
8. Indemnity
You will defend, indemnify and hold harmless Clear Air Stays LLC and its members, employees and agents against claims, losses, fines, taxes and reasonable legal costs arising from your property, your stays, your listing content, your taxes, or your breach of these terms or the law. This section does not apply to a claim caused solely by Clear Air Stays’s own negligence or misconduct.
9. Disputes between a host and Clear Air Stays
You list as a business. Any dispute between you and Clear Air Stays will be resolved by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, including its procedures for mass or multiple filings, seated in Duval County, Florida. The Federal Arbitration Act governs this section. The arbitrator decides questions of arbitrability. Claims may be brought only individually, not in a class, collective or representative proceeding. Either party may seek an injunction in court to protect intellectual property, or bring an individual claim in small-claims court. Florida law governs, and any claim not subject to arbitration will be brought only in the state or federal courts in Duval County, Florida. You may opt out of this arbitration provision by emailing support@clearairstays.com within 30 days of first accepting these terms. We will give at least 30 days’ notice before changing this section.
10. What survives
If you stop listing, close your account, or these terms end for any other reason, sections 4 (payments, fees and refunds), 8 (indemnity) and 9 (arbitration) survive, together with any payment obligation you already owe and any right or duty that by its nature outlives the agreement.
